This is because you have to have mental capacity to set up a Lasting Power of Attorney (LPA) so it will be too late if you are deemed to have lost mental capacity. Also it can take 3 or 4 months to register a Lasting Power of Attorney (LPA) with the Office of the Public Guardian (OPG) so you would not be able to cover a short term incapacity if you have yet to draft or register a Lasting Power of Attorney (LPA) document.
It is very important that, if the need for a Lasting Power of Attorney (LPA) was to arise, you have appointed someone you can trust to act as your Attorney (representative). You can have multiple attorneys and reserve attorneys on your LPAs who will have the legal authority to act on your behalf and ensure that your wishes and needs are fulfilled. There are two types of Lasting Power of Attorney (LPA) LPAs:
Property and Financial Lasting Power of Attorney (LPA)
An appointed attorney can make decisions and take action on your behalf in respect of your property and financial matters so that your finances can be dealt with when you cannot. This could include accessing money, paying bills, buying food or clothing, collecting or claiming benefits or pensions, dealing with HMRC and selling your property. When registering this can be set to be active straight away so it can be used (with your consent) whilst you have mental capacity to cover short term incapacities such as sickness, accidents, travel or military service. Alternatively it can be set to only be used when you have lost mental capacity but that is less flexible. Health and Welfare (Care) Lasting Power of Attorney (LPA)
This can only be used once you are deemed to have lost mental capacity because, until that point, you have the right to determine what is best for you, even if no one else agrees. This can cover things such as where you should live, if you need care – how it will be received, once receiving care your daily routine such as dressing, clothing, feeding, washing, religious or dietary requirements, exercise, medical treatment you will or won’t receive and, if you wish, giving or refusing consent to the continuation of life sustaining treatment or artificial feeding.
You should plan ahead and set up Lasting Power of Attorney (LPA) documents whilst you are able to and have mental capacity.
